TERMS AND CONDITIONS OF THE SPORTGILDIA ONLINE STORE

1. General Provisions

  1. These Terms and Conditions define the rules for making purchases in the SportGildia online store available at https://serwer427299.lh.pl/sportgildia.com/

  3. These Terms and Conditions constitute an integral part of the sales agreement concluded with the Customer.
  4. The Customer is obliged to read these Terms and Conditions before placing an order.
  5. Placing an order constitutes acceptance of these Terms and Conditions.

2. Offer and Prices

  1. All prices displayed in the store are gross prices (including VAT, if applicable).
  2. Prices do not include delivery costs, which are shown during the ordering process.
  3. Product information constitutes an invitation to conclude a contract, not a binding offer.
  4. The Seller reserves the right to change prices, which does not affect orders already placed.

3. Placing Orders

  1. Orders may be placed via the website and partner systems (e.g., Ceneo, if available).
  2. The condition for order processing is providing correct data by the Customer.
  3. The sales contract is concluded when the Seller confirms acceptance of the order.
  4. The Seller reserves the right to refuse order fulfillment if the product is unavailable.

4. Payments

  1. Available payment methods include bank transfer and electronic payments (e.g., Przelewy24, PayU), as well as other methods made available in the store.
  2. In case of non-payment, the order may be canceled.
  3. Order processing begins after payment has been received or confirmed by the payment operator.

5. Delivery

  1. Delivery is carried out within Poland and other countries (if applicable).
  2. Delivery time is usually between 1 and 5 business days, unless stated otherwise in the product description.
  3. Delivery costs are provided before order placement.
  4. Deliveries are handled by courier companies or parcel lockers.

6. Right of Withdrawal (Returns)

  1. A consumer has the right to withdraw from the contract within 14 days without giving any reason.
  2. The withdrawal period begins from the day the goods are received.
  3. To exercise the right of withdrawal, the Customer must inform the Seller via a clear statement (e.g., email).
  4. Refunds are made no later than 14 days after receiving the withdrawal notice or returned goods.
  5. The Customer bears the direct cost of returning the goods unless otherwise agreed.

7. Complaints

  1. The Seller is responsible for ensuring that the goods conform to the contract in accordance with applicable law.
  2. Complaints may be submitted via email to the Seller’s address.
  3. Complaints are processed within 14 calendar days.
  4. If the complaint is accepted, the goods will be repaired, replaced, or refunded.

8. Personal Data (GDPR)

  1. The data controller is SportGildia.
  2. Personal data is processed for order fulfillment, customer service, and legal obligations.
  3. Legal bases for processing are defined in GDPR (Article 6(1)(a), (b), (c), and (f)).
  4. Data may be shared with entities involved in order fulfillment (couriers, payment providers, accounting services).
  5. The Customer has the right to access, rectify, delete, and restrict processing of their data.
  6. Data is not transferred outside the EEA.
  7. The Customer has the right to lodge a complaint with a supervisory authority.

9. Cookies

  1. The website uses cookies to ensure proper functioning and analytics.
  2. Cookies may be used for:
    • technical purposes (necessary),
    • functional purposes,
    • analytical purposes (e.g., Google Analytics),
    • marketing purposes.

10. Final Provisions

  1. The Seller reserves the right to amend these Terms and Conditions.
  2. Orders placed before changes will be processed under the version of the Terms and Conditions in force at the time of purchase.
  3. In matters not regulated herein, Polish and EU law shall apply.
  4. These Terms and Conditions enter into force on the date of publication on the website.
